Latexskin.pl Terms and Conditions

1. General Terms of Sale

Unless otherwise agreed in writing, all sales by Latexskin.pl are governed by these terms. Any deviation from or addition to these terms will not be effective unless expressly confirmed by Latexskin.pl. If any of these terms conflict with the buyer’s order conditions, these terms will take precedence. The buyer’s confirmation of a transaction with Latexskin.pl constitutes acceptance of these terms. No contract is considered formed until an order is acknowledged by Latexskin.pl or the goods are dispatched. Quotations are valid for 30 days unless otherwise specified and do not represent contractual offers.

2. Payment Terms

Payments must be made when placing an order. Payment methods include credit card, bank transfer, or PayPal. Orders will only be shipped after full payment is received.

For contracts involving multiple deliveries, failure to make payment for any delivery may result in Latexskin.pl treating the entire contract as repudiated and seeking damages.

Orders cannot be cancelled once placed, except by mutual agreement, with terms that fully indemnify Latexskin.pl.

The price for the goods, including packing, insurance, and shipping costs, will be specified in the contract.

3. Currency Adjustments

If there is any depreciation in the foreign currency used for pricing against the EURO or PLN after the contract date, the price will be adjusted accordingly, and the buyer will be required to pay the revised amount.

4. Disputes, Refunds, and Exchanges

If a dispute arises, the buyer must still accept and pay for the goods as per the contract and then proceed with their claim.

Refunds are not available.

The management may allow exchanges for items of equal value, provided they are returned in saleable condition and original packaging. Used items will not be accepted. Exchanges will be considered based on mutual agreement.

5. Delivery

The delivery time and location will be specified in the buyer’s order.

Although efforts will be made to deliver on the pre-arranged date, Latexskin.pl does not guarantee delivery dates and is not liable for any loss or damage due to delays.

Each delivery constitutes a separate contract, and failure in one delivery does not affect other deliveries.

The buyer is responsible for obtaining any necessary import licenses.

Any claims regarding defective goods must be made in writing within 3 days of receipt; otherwise, they will not be considered.

Deliveries may be suspended due to events beyond Latexskin.pl’s control, such as fire, war, strikes, or transportation issues. Suspended deliveries will resume at the same rate as specified without affecting the contract terms. The contract includes standard ‘force majeure’ provisions under applicable laws.

6. Risk and Ownership

Risk of damage or loss transfers to the buyer upon delivery, or if the buyer fails to take delivery or provide access.

Ownership of the goods remains with Latexskin.pl until full payment is received for the goods and any other amounts owed.

Until ownership passes, the buyer must store the goods separately, keeping them protected, insured, and identified as Latexskin.pl’s property.

Latexskin.pl may demand the return of goods before ownership passes. If the buyer fails to comply, Latexskin.pl has the right to enter any premises to repossess the goods.

7. Storage Guidelines

Latexskin.pl advises following British Standard 3574 for handling and storage:

Store goods between 15-25°C, away from heat and frost.

Avoid damp or moist storage conditions.

Minimize exposure to light, especially direct sunlight and ultraviolet-rich artificial light.

Keep goods well-wrapped in storage. Latexskin.pl is not liable for defects arising from improper storage, and buyers are advised to insure accordingly.

8. Warranties

Latexskin.pl is not liable for:

Any visible defects or non-conformance unless reported within 3 days of receipt.

Hidden defects discovered within 12 months if reported promptly. The buyer must detail the issue and allow Latexskin.pl to inspect the goods.

These warranties do not apply to goods that have been tampered with, improperly stored, used for an extended period, or subjected to misuse, damage, or fair wear and tear. It is the buyer’s responsibility to ensure the goods are suitable for their intended use. Warranty claims will only be considered for fully paid goods.

9. Limitation of Liability

Except as stated above, all other warranties, conditions, and representations are excluded to the extent permitted by law.

Latexskin.pl will not be liable for any loss, damage, expense, or injury resulting from the use or failure of the goods, except where the liability is limited to the value of the supplied goods.

This contract is subject to the availability of raw materials required for manufacturing.

The contract will be interpreted and governed according to Polish law.
